Practitioners who also serve in fiduciary capacities (i.e. as trustee, guardian, executor) for their clients face ethical considerations that go above and beyond the statutory fiduciary duties. This presentation will focus on the Colorado Rules of Professional Conduct and describe practitioners’ obligations to ethically represent their clients’ interests both during the estate planning phase and after they have taken on a fiduciary role for the client. Practitioners will learn practical applications for these rules to avoid the many ethical traps that pervade this practice area.
