Probate litigation often involves unique evidentiary issues, including laying a foundation for evidence involving a deceased person. This session will review the process for laying a foundation when introducing evidence, including both documents and testimony, as well as an introduction to laying a foundation for expert testimony. We will also discuss how to identify when it is appropriate to object to foundation and how to overcome a foundation objection.
